Wife filed divorce petition but i want to save marriage. plz help?
15 days staying together after marriage on november 30th 2008, my wife is now staying at her house citing the reasons that I dont love her and didnt had sex with her and even not kissed her atleast once. Its true because I behaved like that because of some misunderstandings which i came to know later. Now, she is asking for divorce and planning to file petition but I want to save the marriage. She told me that she will prove that she is virgin even after staying together 15days after marriage.
Is it true that the court will allow divorce on being vergin or not having sex for 15 days after marriage? If she says in court that I’m not able for sex, is there any procedure to prove my ability? If I’m against mutual divorce and really want to save marriage, what procedures should I follow legally? How long will it take her to get divorce if she is not going to change her mind?
Firstly engage a sensible lawyer to guide you rightly for matrimonial law in India. Secondly the you both cannot for the general rule apply for divorce even by mutual consent within first year of marriage unless there exist an exceptional case of hardship or depravity,which doesn’t seems in your case. As far not indulging in sex for fifteen days is no big issue for making it a case of mental cruelty of depriving of the sexual bliss as a married spouse & causing breaking of the matrimonial home. The none consummation of marriage can be claimed for annulment of marriage as a ground if there has been wilful refusal or the impotency of the respondent in this case the husband. You don’t seems to be impotent medically or otherwise but due to circumstances & misunderstanding could not attain penal erection for sexual intercourse,this is only a temporary phase which doesn’t amount to complete incurable impotency,hence cannot be made a ground for annulment of the marriage on this ground. Your wife need marriage counselling not from a marriage counsellor only but even a sensible lawyer who will make her understand the legal issues involved in the marriage which she seems to be not well informed so engage one good lawyer to do this work for you & don’t forget to pay his consultancy fee.

you guys are acting like kids. your getting divorced because of sex? a judge will laugh in her face if that’s what she goes and tells them. I have heard of some messed up reasons but this is crap. A judge is not going to order you to see if your sh** works properly that is not his business. You can fight your divorce or at least postpone it for a while but eventually you will give before she does. If you do not contest the divorce and let her go so she can be happy else where it will take 3 months from the time she starts the first petition. If shes not happy with you let her move on and have a different life and you do the same.

Well, legally I believe what she’s doing is an annulment. Depending on the state laws (which are all different by the way), in some states it doesn’t have to be mutual – she can obtain it without your consent. I would contact a divorce lawyer and find out your rights. And if you want to save the marriage, maybe you could suggest that you two go to marriage counseling together. Good luck.

Court doesnt give a damn about being a Virgin or not. Not really their field of expertise. They end marriages for those who want it so. Not really sure what, where, or why your not having relations with your wife and apparently neither is she. If you have a dysfunction that’s normal but perhaps it should have been discussed BEFORE the marriage took place.

You have to make believe that you are true to your heart.

If you have a genuine defect, do not try to fake and endanger a girl,s future. Get urself treated.
Otherwise, it should be taken as a blessing. You need not waste ur future with a girl who filed for divorce for not getting sex within 15 days. Let her go.
In anyway, clear introspection is needed. The world is so big and wide that you can have your life in spite of set backs.

if wife has intiated then there will be sound reason for the split and now they stand stronger in court so if have to get her to your side you have to persuade the counsel that yu are not wanting to give divorce.but when she is not interested in staying with you you become helpless.

Now, for you my friend. You said that she wants to file a divorce after 15 days of marriage because she claims you are impotent.
Legally speaking:
First file an RCR (Restitution of Conjugal Rights) under section 9 of the Hindu Marriage Act (if you are an Indian). Then she will have to reply to the notice of RCR. Meanwhile if she does not reply, and she files for divorce, there will be anyways a legal procedure of marriage counselling. If she still wants a divorce, agree to it because, if this is how it is in the start, how will it end?
A friend in this thread talked about annulment. I believe its right. Annulment will fall under Section 12 (HMA) and divorce Under section 13 (HMA).
Uh! Uh!… we will talk about the maintenance and the alimony later.. when she files for it u/s 24(HMA)..

If she knows people who are a part of the government then you will be in trouble over nonsense (people in government always abuse their power). You should speak to her because communication always helps. Tell her everything and force her not to file for divorce. Ask her if it is a really worth it and express your love to her. I hope everything works out for you. 15 days is ridiculous, though. She is not right.
